This Privacy Policy describes what information we collect about you, how we collect it, how we use it, with whom we may share it, and what choices you have regarding it. This Privacy Policy applies to your use of our Web site (the “Site”) and any other means by which we may collect information about you, including information you may provide to us other than on the Site. By accessing and using the Site, you agree that you have read and understand this Privacy Policy and that you accept and consent to the privacy practices (and any uses and disclosures of information about you) that are described in this Privacy Policy.

  1. What information do we collect, and how do we collect it? 

We and our third party service providers (“Contractors”) may collect certain information from or about you in connection with your use of, or your submissions to or via, the Site  including anonymous information, which is aggregate non-identifying data that we   use to administer the Site  and personally identifiable information, which is any information that personally identifies you, and includes, but not limited to, your name, email address, postal address, company, and telephone numbers (together anonymous information and personally identifiable information “Collected Information”). In addition, we and our Contractors may retain the content of, and metadata regarding, any correspondence you may have with us or our representatives, regardless of the mode of communication by which such correspondence was made. This information helps us to improve the Site and the online content, materials, and services that we make available on the Site, and to more effectively and efficiently respond to both current and future inquiries.

a. Information collected via technology
As with many other websites, the web servers used to operate the Site may collect certain data pertaining to you, including data regarding the equipment and communications method that you use to access the Site, and your activities on our Site. For security reasons and to confirm the integrity of the Site, we and our Contractors may combine components of these data with Collected Information, which may identify you. Unless otherwise described in this Privacy Policy, such identifying information (which is also deemed “Collected Information” hereunder) will be used solely for our business purposes. 

In addition, the Collected Information may reveal such things as the Internet protocol (“IP”) address assigned to your computer, specific pages that you access on the Site or prior to or after visiting the Site, and the length of time you spend at the Site. b. Cookies and beacons
We want you to be aware that certain tools exist to help us service and recognize you. d. Other Tracking Technologies
We also use web beacons to monitor the traffic patterns of visitors from one enlivant.com page to another. A web beacon is an object that is embedded in a web page and is usually invisible to you but allows us to confirm that you have viewed the web page. Our systems do not recognize browser “Do Not Track” signals. 

While we do not partner with or have special relationships with ad server companies, advertising agencies, advertising networks, and other companies may place advertisements on the Internet generally, and may use their own cookies, web beacons, and other technology to collect information about you. We do not control the use of such technology and have no responsibility for the use of such technology to gather information about you. If you choose, there are utilities available for purchase from independent software providers to install on your computer as well as tools/preferences you can choose through most web browsers to make website visits anonymous. Of course, cookies let you have a more satisfying website experience, so we recommend that you leave them turned on. A large number of products may be accessed without the use of cookies, or anonymously. e. Consumer Personal Data Rights
We support the right of our visitors to choose the right to opt-out of targeted advertising, the sale of personal information, and profiling in furtherance of decisions. Access, Correction, Data Portability and Deletion

You have a right to know about the personal information that we hold about you, including the right to correct, amend, receive, or delete the information that we have on file if it is incorrect. If you wish to exercise these rights please contact us by email, postal mail at the addresses below or use the webforms we have provided on this website.

At any time, you may revoke your consent, cease further use of your email address to send you updates, and direct us to delete the information you have supplied. Although it is not always possible to remove or modify such information, we will make reasonable efforts to do so. If you have given us information for one of our Contractors we mentioned above and we have already passed it on, we cannot delete or change the information.

2. How will we use the information you provide to us? 

In addition to the uses described above, we and our Contractors may use Collected Information to analyze and improve the content, materials, and services that we make available on the Site, to notify you of changes made to the Site, to evaluate user needs and improve the Site content, to send you promotional materials, and support our continuing efforts to offer users the information and services we think they want most. If you contact us for support or assistance, we may use Collected Information to provide service and support to you. You agree that we may use automatic telephone dialing systems and technology to contact you by phone or text message at the telephone number provided, and send you email notifications regarding promotions and related to our services that we provide to you. We and our Contractors may store Collected Information for as long as needed for the purposes indicated in this Privacy Policy, which may be indefinitely. 

3. With whom do we share the information we collect?

We may share Collected Information with certain of our Contractors (e.g., our web hosting provider) in order to provide the Site to you. We may also share Collected Information with some of our business and marketing partners in furthering our mission as an organization or delivering the content, materials, and services available on or through the Site to you. We and our Contractors may also produce reports on Site traffic, usage patterns, and similar data generated from Collected Information, and we may share these reports with our business and marketing partners and others.

4. What choices do you have?

When corresponding  with Enlivant or our representatives, or when making a request for information or otherwise interacting with us or others through the Site, you choose what information to supply, what questions or comments to submit, whether you wish to receive further information, and by what method of communication such information should be delivered. Please take care to share only such information as is needed or that you believe is appropriate. You are under no obligation to provide us with personally identifiable information, but without it we may not be able to provide you the products or services you request. You may contact us as indicated below if at any time you would like to ask us about our data collection and information security practices.

5. How do we protect information collected about you?

When have put in place certain security measures to safeguard Collected Information, but the storage and communication of Collected Information can never be completely secure. Hence we do not guarantee that information that you transmit or otherwise supply to us, or any communications conducted on or through the Site, is or will be totally secure. If you become aware of any breach of Site security or this Privacy Policy, please notify us immediately.

6. Interactive areas

We may provide areas within the Site that allow users to post commentary and other materials. If we do, these interactive areas, such as discussion forums, are intended to enhance the user experience and build a healthy community around the products and services available through the Site. Enlivant is not liable for information posted in interactive areas of the Site. You acknowledge that, should you participate in such interactive areas, the information you voluntarily post about yourself and third parties in such areas might be accessed, collected and used by third parties other than Enlivant or our Contractors.

7. We may change this Policy 

From time to time, we may change our privacy practices, and this Privacy Policy, because of changes in relevant and applicable legal or regulatory requirements, our business practices, or in our attempts to better serve your needs and those of our other customers. We will try to notify you of any such changes, and a revised policy will be posted on this Site. We encourage you to regularly review the current version of this Privacy Policy on the Site.

8. Location of this Site

This Site is hosted and operated in the United States. However, we and our Contractors may, in our effort to provide the Site, store Collected Information in the United States, or we may transfer it to, and store it within, other countries. 

Those who access or use the Site from jurisdictions outside the United States do so at their own choice and risk and are solely responsible for compliance with local law. If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States or elsewhere. By using the Site, you signify your agreement to the terms of this Policy. Please note that the level of legal protection provided in the United States or other non-European countries from which you may access our Site may not be as stringent as that under European Union privacy standards or the privacy laws of some other countries, possibly including your home jurisdiction.

9. Communication with children

We recognize the unique privacy concerns regarding children. We are committed to carefully protecting privacy where children are involved no matter the point of contact. In particular, our intention is to fully comply with the Children’s Online Privacy Protection Act (COPPA). Per COPPA guidelines, we do not knowingly collect personally identifiable information from children under the age of 13. If a parent or guardian is made aware that a child under the age of 13 has provided us with personally identifiable information through any point of contact, we ask to be contacted at the address or phone number below or by email via marketing@enlivant.com and we will delete the information about the child referenced from our files.

Our Site may provide links and/or ad banners to other websites or sponsors that we do not control. When you click on one of these links, you will be transferred out of the Site and connected to the web site of the organization or company that you selected. We are not responsible for the nature, quality or accuracy of the content or opinions expressed in such web sites, and such web sites are not investigated, monitored or checked for quality, accuracy or completeness by us. Inclusion of any linked web site on the Site does not imply or express an approval or endorsement of the linked web site by us, or of any of the content, opinions, products or services provided on these web sites. Even if an affiliation exists between the Site and a third-party web site, we exercise no control over linked Site. 11. Health Insurance Portability and Accountability Act of 1996-HIPAA

HIPAA is Federal legislation that was made law by Congress in 1996. With all the advancements in electronic technology, Congress recognized the need for Federal privacy protections of individually identifiable health information and therefore has mandated privacy protections. The HIPAA Privacy Rule is aimed at safeguarding the privacy of our residents through increased accountability in the areas of privacy and security. The Privacy Rule establishes a foundation for Federal protections for the privacy of Protected Health Information (PHI). The HIPAA Security Rule is more specific and calls for protection of PHI in electronic formats. Compliance with the HIPAA Privacy Rule is required for Enlivant because transmit resident health information electronically related to health care claims, payment or coordination of benefits.
